US grid bills move forward, but implementation will be complex

In recent months, the US legislative push to make data centers shoulder more of the costs to upgrade the electrical grid has reached federal level — Capitol Hill. The federal Ratepayer Protection Act (H.R. 9340) aims to make new large-load consumers, a codeword for data centers, pay for the investments into the new electrical transmission and reliability capabilities that are specifically required to serve their additional power demand.

However, while the proposed act signals federal recognition of the growing tension between ratepayers and data center companies, it delivers little new authority to enforce solutions. Ultimately, it is public utility commissions (PUCs), the state level regulators, that oversee most project approvals and rate settings. Rather than catalyzing a new relationship between data centers and the grid, the bill instead follows states that have already taken steps to modify how grid costs are allocated to consumers.
